Terms and Conditions
The following terms and conditions apply to all persons or other entities (“you”) that are attending any session (“Session”) organised by [The Forest Bathing Company] (“we” or “us”). Please ensure you have read and understand the following:
1. Acceptance of terms and conditions
By completing the registration form for a particular Session, you are agreeing to the terms and conditions set out below (“Terms”) and they will be incorporated into the contract between us (“Contract”). You will ensure that you will comply with these Terms. The Contract is formed when send you a Confirmation email.
2. Payment
The fee for attending the Session (“Registration Fee”) will be as stated on the booking form for the relevant Session. Prices are exclusive of VAT except where expressly stated otherwise. All payments for the Registration Fee must be made in full at the time of completing the registration form and in any event prior to the date of the Session. Payment will be made via our merchant account provider, and you consent to us passing your necessary details to the merchant account provider and to them processing necessary information about you. We reserve the right to run price promotions as we think fit.
3. Refunds – Cancellations – No shows
If you are unable to attend the Session you have booked and cancel 7 (seven) days before the Session date you can choose to reschedule for another Session the following month by emailing nicola@theforestbathingcompany.com or receive a full refund. We must receive the email 7 (seven) days before the event is due to take place. You will receive confirmation that we have received your email either by email or text message to the phone number you supplied on your Registration form. We may, at our discretion, charge an administration fee of up to £5 (five) for making such changes. I have to pay to use the location and fess must still be covered.
If you cancel your session 3- 5 days before the Session date you can reschedule for another the next months session or receive 50% refund. We may, at our discretion, charge an administration fee of up to £5 for making such changes
If you cancel 2 (two) or less days of the Session booked date no refund will be given and no alternative dates will be offered.
If you have not cancelled your Session and do not arrive or arrive late to the Session after the time we have left the meeting point no refund will be given and no alternative Session date will be offered.
Cancellation
There may be circumstances in which we need to cancel the Session such as bad weather conditions, or notification from the site owner or manager stating that it is unsafe. In such circumstances, we will provide you with a credit to the
same value as your original ticket purchase price, so you can rebook another session within 6 (six) months from the date the original session was to due to take place.
The Forest Bathing Company reserves the right to cancel Sessions due to bad and or unsafe weather conditions for healthy and safety reasons.
4. Postponement or change to venue
There may be circumstances in which we need to postpone the Session or change the venue at which the Session is to be held and if we do, we shall advise you of this as soon as we possibly can. Situations like this are very rare and will only take place if we have been contacted by the landowner/park ranger and it is usually for health and safety reasons. These incidents are totally out of our control and no refund will be given. You will be able to reschedule to another Session within 6 months of the original Session date you booked to the same value ticket.
If the weather becomes unsafe during a Session, the Session will be brought to a stop and no refund will be given as this is not in our control.
Liability
Our sole liability in relation to any cancellation, postponement or change of venue shall be limited to the price paid by you for such Sessions and we shall not be liable under any circumstances for any consequential losses.
5. Your obligations
If you act in any way which in your opinion or behaviour is likely to cause any harm or nuisance to any person at the Session, you will be required to leave the Session and we shall not be liable to refund your Registration Fee or any other payment.
You must comply at all times with the health and safety policy of the location. You must comply with all requests from us or the location with regard to health and safety and failure to do so will result in you being asked to leave the Session (in which case no refund will be provided). You may not bring any equipment or items of a hazardous or dangerous nature to the session.
No pets or persons under the age of 18 years are permitted to attend any Sessions.
If you bring pets of any kind or persons under the age of 18 years to the Session with you. You will be asked to leave and no refund will be given.
You shall not cause any damage to any part of the location. You are solely liable for any damage caused by you, you will be held liable for any damage that you may cause to the location.
You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to the Session by you.
6. Photography and filming
We may wish to photograph or film the Session and reserve the right to do so for the purposes of promoting future Sessions or otherwise. You consent to our filming you and any persons attending the Session with you. You have the option to opt out of photographs or filming of you personally on the Registration form that you have to complete before attending the Session
7. Data protection
We will communicate with you using the contact details provided on the Registration Form for the purposes of the Session and future marketing material of our Sessions and other events we may take part in as a company. You have the option to opt out if you wish.
Tickets
We shall not send you tickets for the Session. We will have your name on the attendee list and if you have paid the Registration Fee you shall be provided with access to the Session.
8. Limitations of Liability
Whilst every reasonable precaution is taken by us to ensure security and safety at the Session, we shall not in any way be liable for any loss or damage suffered by you whatsoever in relation to the Session, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by negligence.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, any fraudulent misrepresentation or any other liability for which it is unlawful to exclude or limit liability.
Our total liability for any matter arising out of the Contract shall in all circumstances be limited to the price paid by you for the Session and we shall not in any circumstances be liable to you for any consequential loss whatsoever.
9. Governing law
These Terms shall be governed by English Law and your hereby submit to the exclusive jurisdiction of the English Courts.
